Scott Fitzgerald), 2 pp, 4to, Culver City, January 16, 1939, on M-G-M letterhead, being a typed carbon regarding Fitzgeralds release from his studio contract, with Swanson Agency stamp at center right of page 2, staple perforations to upper margins of both leaves, ink smudge to lower right corner of 1st leaf, light creasing and toning.
After a year and a half under contract to Metrowith only one earned screen credit during that timeFitzgerald was released by the studio. This document confirms his departure, with the studio retaining the right to use the authors name and likeness to promote the results of his services. In part: Dear Mr. Fitzgerald: / This will confirm the following agreement between us: / 1. Your employment under any and all previous agreements between us and particularly under that certain contract of employment between us dated August 21, 1937, as amended, is hereby cancelled and terminated as of January 20, 1939. Each of us hereby releases the other of and from all further liability and obligations under said contract from and after that date, and of and from all claims and demands of every kind which either of us ever had or now has or may hereafter have or claim to have against the other, arising out of or based upon, directly or indirectly, all such contracts and agreements and particularly said contract of August 21, 1937. / 2. Nothing herein contained, however, shall be construed to constitute a waiver or release by us of any rights which we may have in and to the results and proceeds of services rendered by you for us under all such contracts and agreements and particularly said contract of August 21, 1937, or of the right to use your name, voice, and/or likeness in connection with the advertising and exploitation relating to such results and proceeds of your services, it being agreed that we reserve all of said rights.
